Personal Training Agreement

Between Martin Salt trading as ‘Personal Best’, (the Trainer) and  __________________ (the Client).

Defined terms

​

I and Trainer:                     Martin Salt
You and Client:                 Individual named in this Agreement
Session:                             A personal training session where the Trainer instructs the Client in exercise
Initial Term:                       Time agreed by the Trainer and Client and as referred to in the Programme
Discovery Meeting:          Meeting between the Trainer & Client where goals are set & data collected
Programme:                      A schedule and details of exercises to be undertaken by the client intended
                                           to deliver the agreed goals

1:  My commitment to you

​

​

1.1          Confidentiality.

​

All information You give me will be kept in confidence and subject to the General Data Protection Regulation (see separate policy). Your personal details and medical information will not be made available to third parties unless permission to do so is granted by you.

​

1.2          Recommendations.

​

Using my judgment and experience, I will suggest certain exercises and other lifestyle advice that I believe will help you achieve your personal goals, but if at any time you have specific requests please tell me so I can try to accommodate them.

​

1.3          Referral.

​

I intend to work with you within the scope of my knowledge and competencies as a registered exercise professional (CIMPSA). Therefore when I believe it is in your best interests to see another health professional, I will refer you appropriately.

​

 1.4         If I (the trainer) cancels a Session or runs late.

​

 Unforeseen circumstances may arise which require our Sessions to be rescheduled. In this event the following policy will apply:

​

1.4.1  If I am forced to cancel a training Session I will:

  • Provide you with as much notice as possible, and

  • make up the Session at a time that is convenient to you and within the Initial Term of this agreement.  If  the Session cannot be so rescheduled then I will reimburse you the cost of the Session cancelled.

1.4.2  If I run late in starting our Session I will extend the Session time accordingly or make it up at a future date, whichever is most convenient to you.

1.5          Cancellation of this Agreement

​

While very unlikely. I reserve the right to cancel this Agreement at any time and for any reasonable reason.  Any unused but paid for Sessions will be re-imbursed to the Client.

​

 

2: Your responsibilities to me

​

​

2.1           Disclosure of information.

​

Please disclose all health information as requested at our Discovery Meeting and keep me updated and informed of any changes to your health status. This includes all medical conditions; physical and mental, injuries, allergies, and medication you are taking. If necessary, you may need to seek clearance from your doctor before participation in the Programme I recommend.

​

2.2          Accepting potential risks.

​

Whilst for most people exercise is hugely positive with many health benefits, there remains some risk that I require you to be aware of and for you to sign the informed consent and disclaimer that I will provide.  The client will communicate any discomforts, pain or concerns experienced during or arising from a session.

​

2.3          If you (the client) cancel or run late.

​

2.3.1  If you cancel your session with less than 24 hours’ notice, or fail to show your session will be forfeit (no refunds or re-booking) and no charitable donation will be made

2.3.2 If you cancel your session with notice with more than 24 hours then I will rearrange. 

2.3.3 If you (the client) are late to a session, I will do my best to get the most out of the remaining time left in the session as I may be unable to run over time due to previously arranged client commitments.

2.4          Other terms.

​

2.5 Being prepared for your session.

​

To get the most out of your session I recommend the following:

• Where appropriate have a small snack or light meal two or three hours before your session

• Be sure you are well hydrated and avoid alcohol prior to training

• If you are feeling unwell before your Session please contact me

• Bring a small towel and water bottle to your Session

• Wear appropriate clothing and footwear (ask me if you are unsure)

• Be ready at the appointed time

If the Session is taking place at your premises then I ask for you to please ensure that, so far as it is reasonable to do so, that the environment  is safe for both Trainer and Client.

2.6  Communication and Commitment

​

While I can give you the tools and encouragement to reach your goals, ultimately you will need to assume responsibility for making the required changes. I can best help you with this process if you keep me fully informed of any issues that arise for you and if you have any questions or concerns whatsoever please don’t hesitate to voice them with me.

 

3. Pricing and fee options

​

The nature of the bespoke service I provide requires a tailored approach to pricing and fees. By entering this Agreement you are initially only agreeing to pay for the Programme Preparation as described and set out in 3.1 below.  Clauses 3.2 and 3.3 are optional and will apply after You confirm your agreement in writing or by conduct i.e. attending a second Session. This means that before committing to the programmed Sessions (and it's substantive cost), you will have experienced one Session with me and have seen the Programme.

3.1   Programme Preparation and first training session.

​

3.1.1      There is currently no charge for the Discovery Meeting

3.1.2     After the Discovery Meeting, when we have agreed your goals, I will prepare an outline bespoke  training Programme.  There will be a flat fee payable for preparation of this Programme which includes the first training Session and any subsequent amendments to the Programme.

3.1.2     The flat fee is to be paid to the Trainer after the Discovery Meeting but before the first training Session.

 

3.2    Programme fee

​

3.2.1        At the Discovery Meeting we will agree your goals, the number and frequency of the Sessions, and I will provide an indication of the Programme fee. The Programme fee will be confirmed for your agreement after the first training Session and notified to you in writing together with details of the Programme.

3.2.2      The Programme fee will include a sum for the training sessions and may also include an allowance for regular reviews. A discount for multiple sessions may be applied.

3.2.3      The Programme fee will be divided by the number of weeks of the Initial Term and that sum will be paid on a weekly basis in advance of the first Session scheduled for that week.  It is suggested that this should be done by bank transfer ideally by direct debit.  Failure to pay in advance will remove the obligation for me to deliver the Session.

3.2.4      Amendments to the Programme

If you agree and scheduling allows additional training Sessions can be added to the Programme.  Any additional sessions must be paid in advance . Current prices subject to a discretionary discount for volume are:

1 Hour training session

  • if training location is within 20 mins car travel of GU47 0ZZ - £65

  • if training location is more that 20 mins car travel of GU47 0ZZ - £75

3.2.5      Commitment from you to the Programme is important to achieve your goals, therefore if after the Programme commences you require any amends including a reduction of time and/or intensity to the Programme and a proportionate reduction in the fee then this will be solely at the Trainers discretion.  Reasons for a reduction and or reimbursement would include but are not limited to illness , incapacity or compassionate reasons.

3.3          Maintenance Retainer

​

3.3.1      Before the completion of the Initial Term I may offer, for your acceptance, an ongoing service to ensure you maintain the progress you have made.

3.3.2      If offered you can decide which of the following options is most suitable for you. Both options require a 6 month commitment and are dependant on a monthly direct debit to be set up.

3.3.2.1   Option 1 – light touch

One telephone review with you every 2 weeks - £25 p.m. or

3.3.2.2 Option 2 –  more involved / loyalty price

One weekly Session for which a £10 discount from the rate payable at that time for each session will be applied

3.4  Payment arrangements

​

Direct weekly bank transfers or direct debit in advance are preferred, although other methods including cash or cheque are accepted.

 

 4: Other Terms of this agreement

​

4.1    The Client understands that they have the right to stop at any time during a session and that they should inform the trainer immediately of any symptoms such as fatigue, shortness of breath or chest discomfort.

 

4.2    The Client understands that exercise involves certain risks, including but not limited to, spinal injuries, heart attack, stroke, death and injuries to bones, joints or muscles, however,

4.3    The Client agrees to voluntarily participation in the Programme and assume all risks. The Client declares that they have read, understand and agree to the contents of this agreement in its entirety.

​

4.4    The Client  hereby waive, release and discharge the Trainer from any and all claims or liability for any present and future injuries or damages resulting or arising from my participation in any activities including but not limited to exercise, personal training or use of the equipment including any injuries and damages caused by the negligent act or omission of any of those persons or entities

​

4.5    The Client understands that they are paying the Trainer for their services as outlined in this agreement and as set out in the Programme (subject to any agreed amendments during the Initial Period). The Trainer will deliver their Sessions and advice to the best of their ability, and respect all applicable UK laws. The Client agrees to make all payments by the due date.

ACKNOWLEDGEMENT OF THIS AGREEMENT - I have read and understood this agreement. A copy will be provided to the Client within 7 days.

Privacy Policy

​

 

Identity of the Data Controller

 

In line with the General Data Protection Regulation (GDPR)  May 2018:
 

  • The “Personal Best” Controller is Martin Salt.
     

What Information is collected and why?

 

  • Personal contact information for clients will be collected when a client makes contact with Personal Best (“PB”) or at their first meeting.

  • Clients can make initial contact via email, phone, App or social media.

  • During any meeting or training session whether in person or virtually with Martin Salt sensitive and/or private information about the client may be recorded by hand in the clients written records or recorded on a digital App.

  • This information, may include but is not limited to:

    • Personal identification and contact information

    • Client’s Weight

    • Body fat percentage

    • Body photographs

    • Health information as included in the PAR-Q

    • Details of food and drink consumption

    • Results of various body tests – i.e. heart rate, vo2 max

    • Food consumption

    • Attendance at and a record of activities undertaken at training sessions to include, reps, weights, sets

  • The information is needed and recorded only for the purpose of furthering the clients’ fitness / health goals as agreed with PB.

 

Will your information be shared?

​

  • Your information will not be shared with anyone without your specific consent.
     

How long do we hold your data.
 

  • Data will be retained as a long as you remain a client of PB.

  • Data will be held for a maximum 1 year after the clients ceases to be a client.  After this time their data will be destroyed and/ or deleted.

 

How can data be updated or corrected?
 

  • You have the right to request a copy of the information that is held about you.  If you would like a copy of some or all of your personal information, please email martin@personalbestpt.co.uk want to make sure that your personal information is accurate and up to date.  You may ask us to correct or remove information that you think is inaccurate.
     

Complaints
 

  • Clients’ have the right to complain to the Information Commissioner’s Office (ICO) if they believe that there is a problem in the way that PB is handling their data.

 

Consent:

 

I thereby give my consent to PB recording and keeping my data only for the reasons stated above.
